Please read these Terms of Service carefully before accessing or using FOMO NOMO. By using the platform, you agree to be bound by all terms, conditions, and waivers set forth below.
By downloading, registering for, accessing, or using the mobile application or website provided by FOMO NOMO LLC ("FOMO NOMO," "we," "us," or "our"), you enter into a legally binding agreement to comply with and be bound by these Terms of Service. You represent and warrant that you are at least 13 years of age (or the legal minimum age in your jurisdiction) and possess the legal authority to enter into these Terms.
FOMO NOMO provides an interactive platform enabling users to discover, publish, share, and interact with localized event information and user-generated content. We reserve the right to modify, suspend, restrict, or discontinue any portion of the service at any time, with or without notice, and without liability to you.
Content Rights & License Grant
You retain ownership of the content you submit. However, by posting content to FOMO NOMO, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, and distribute your content across the platform.
Strictly Prohibited Actions
You may not post illegal, harassing, defamatory, sexually explicit, or fraudulent content. You are strictly forbidden from scraping data, reverse-engineering the application, using automated bots, impersonating others, or spamming the community.
FOMO NOMO functions solely as a passive digital bulletin board for discovering events and social gatherings. We do not host, organize, manage, vet, verify, or background-check any event, host, or attendee. YOU EXPRESSLY ASSUME ALL RISKS associated with attending in-person events, meeting third parties, or participating in activities discovered through the platform. You agree that FOMO NOMO LLC shall not be liable for any personal injury, death, property damage, harassment, emotional distress, or loss resulting from your real-world interactions.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOMO NOMO LLC DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED $100 USD.
You agree to defend, indemnify, and hold harmless FOMO NOMO LLC, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or related to your use of the app, your content, your violation of these Terms, or your attendance at any offline event.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. You agree to submit to the exclusive personal jurisdiction of courts located in Florida. YOU AND FOMO NOMO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We reserve the right to revise these Terms at any time. Continued access or use of FOMO NOMO following any updates constitutes acceptance of the modified Terms.
